Marikina cop faces murder charge over ‘EJK’ case

Metro Manila (CNN Philippines, December 10) — A Marikina policeman is facing several criminal charges, including a murder complaint, over the fatal shooting of a 23-year-old construction worker in a supposed scuffle in October.

Parents of Kim Lester Ramos filed Monday murder and planting of evidence charges against PCol Herjonner Soller at the Makati City Hall of Justice.

Ramos’ friend, Lauro Lagarde Jr., who survived the shooting, also filed a frustrated murder charge against Soller.

Sa ngayon po haharapin ko talaga sila kasi gusto ko po mabigyan ng katarungan ang pagkamatay ng anak ko. Sana naman magsabi siya ng katotohanan … Sana po suportahan ako ng mga taumbayang maipanalo ‘yung anak ko,” Ramos’ father, Norman, said.

[Translation: I will now face them because I want to give my son’s death justice. I hope that he (Soller) tells the truth … I hope the people would support me so I can win my son’s case.]

The Initiatives for Dialogue and Empowerment through Alternative Legal Service, which represents the Ramos family and Lagarde, said Soller shot the two men after he accused them as drug addicts.

Kim was shot at the back of his head while he was fleeing the scene, while Lagarde survived by playing dead after he was shot at his hip.

The Ramos family says Kim’s shooting could be a case of extrajudicial killing, belying Soller’s claim that a tussle over the policeman’s gun led to the young man’s death.

Lagarde recounted the shooting in a Rappler report, where he said Soller shot him after he asked him why he called them drug addicts in an earlier encounter. He said the policeman then ran after Kim and shot him as well.

In contrast, Soller said in his affidavit that Lagarde snatched his bag containing a pistol which eventually led to his shooting. He also claimed that Kim pointed a gun at him, forcing him to shoot.
